just my 2 cents:
I do think that chasid's question is a good question (i do not know where he is coming from, or what answer he expects though).
Nobody would be upset if he was to ask that question concerning whether it is mutar deoraissa or derabannan to set a trap on Erev Shabbos, and an animal gets trapped on Shabbos.
We have an obligation to clarify the halacha to the best of our ability. Out of intellectual honesty we have to make clear what is a deoraissa, derabannan, chassidus, lechatchila, bedieved etc...
Once this is clear, then people like the Rosh Yeshiva in the story "
Today is the first day..." can help people like Yerachmiel make the first steps towards recovery. Yerachmiel decides to stop homosexual activities (which in the worst case is mamash a deorayssa), and only later gives up masturbation.
From that story it seems that the road to recovery is a long and winding one, and the more clear and precise our knowledge is, the better we can help and be helped.
But it also says, the Torah can be a sam chayim or a sam maves. One can easily rationalize one owns negative behaviour based on psukim, r"l.
May G-d help us all to be strong, and to learn the Torah lishma, so that the Torah can become a sam chayim for all of us. Especially now, the week of Shvuos.
